Can You Sell a House with Asbestos?

Yes, you can sell a house with asbestos. It is legal, it is common, and I have bought plenty of them myself. Around half of UK homes built before 2000 contain asbestos somewhere in the fabric. So if you have just found it in an Artex ceiling or a garage roof, you are not alone. The only real question is how you sell, and how much a jittery buyer will try to knock off.

I have walked through hundreds of these properties. Pipe lagging, old fuse boards, cement sheets, textured coatings. None of it puts me off. This guide is written from your side of the table, not the agent’s.

Is It Illegal to Sell a House with Asbestos?

No, it is not illegal to sell a house with asbestos. There is no law forcing you to remove it before you sell. Asbestos was banned in the UK in 1999 under the Asbestos (Prohibitions) (Amendment) Regulations 1999, with blue and brown asbestos banned back in 1985. But a ban on new use is not a ban on selling a property that still contains it. Millions of homes do.

According to the Health and Safety Executive, there are still around 5,000 asbestos-related disease deaths every year in Great Britain, which is why the law cares deeply about one thing: honesty.

Do You Have to Declare Asbestos When Selling a House?

Yes. If you know asbestos is present, you must declare it on the TA6 property information form. Concealing it breaches the Consumer Protection from Unfair Trading Regulations 2008, and a buyer can pursue you long after completion. If you genuinely do not know whether asbestos is present, you are not legally required to commission a survey to find out. So the rule is simple. Do not lie, and do not guess out loud. Tell the truth about what you know and you are protected.

Can You Sell a House with Asbestos in It Without Removing It?

Yes, you can sell a house with asbestos in it and leave every scrap of it in place. Undisturbed asbestos in sound condition can sit safely for decades. Removal is only usually needed when the material is damaged or crumbling. Licensed removal is not a DIY job, and stripping a whole house can climb into five figures. So most sensible sellers manage it, disclose it, and price accordingly, rather than tearing the place apart.

Does Asbestos Devalue a House?

Usually, yes, asbestos devalues a house. Buyers do not price it on facts, they price it on fear. Every removal quote gets rounded up in their heads, never down. Do Surveyors Check for Asbestos?

Not in any meaningful sense. A standard RICS Level 2 or Level 3 survey is visual only. The surveyor notes anything that “may contain asbestos” and recommends specialist testing, but takes no samples.
